program GENERAL TERMS AND CONDITIONS OF USE OF A LOYALTY PROGRAM OFFERED BY AU PETIT BONHEUR 164 RUE DU PHARE 85360 LA TRANCHE SUR MER EN VENDEE FRANCE Via the website https://www.hotel-restaurant-aupetitbonheur.com Version:15012023 of January 2023 These Terms and Conditions of Use apply only to the Loyalty program(s) (hereinafter the " Loyalty Program") offered by Au Petit Bonheur on the https://www.hotel-restaurant-aupetitbonheur.com website (including the mobile version), which can only be used from these websites and applications and to which a customer (hereinafter referred to as "the Customer") has subscribed through the account he has created on the website https://www.hotel-restaurant-aupetitbonheur.com These General Terms and Conditions of Use do not apply to loyalty programs offered by Au Petit Bonheur by a means other than those detailed above (in particular any loyalty program that can be used from a website and/or another smartphone application than those identified above). The Client declares that he/she has read and accepted these General Terms and Conditions of Use. Any subscription by the Customer to a Loyalty Program materializes, on the part of the Customer, the acceptance of these General Terms and Conditions of Use. These General Terms and Conditions of Use are supplemented by the Specific Conditions specific to each Loyalty Program, accessible from the page presenting the Loyalty Program. These General Terms and Conditions of Use may be subject to change. The applicable Terms and Conditions of Use will be those corresponding to the most recent version.1. GENERAL PRESENTATIONThe Loyalty Program is available on the web. https://www.hotel-restaurant-aupetitbonheur.com (including mobile version) a Loyalty Program. The purpose of this program is to allow Customers to accumulate, under the conditions detailed in Article 2, when they order on the website, Au Petit Bonheur points determined in the Program, in order to benefit from an advantage (hereinafter the "loyalty program(s)"). The Au Petit Bonheur Loyalty Program is: - Program by purchase tier: Loyalty points are acquired in increments of €1, which allows the Customer to accumulate points under the conditions detailed in Article 2 and to have the possibility of benefiting from points acquired, according to the levels reached, as detailed in the Special Conditions of the Loyalty Program to which he has joined. Membership in a Loyalty Program and the Benefits obtained within the framework of a Loyalty Program are nominative, personal and non-transferable. The points accumulated as part of a Loyalty Program have no monetary value and cannot carry any other consideration than that of obtaining the Benefits offered, as detailed in the Special Conditions of the Loyalty Program.2. On this page, they will be able to read the Special Conditions of the programme (in particular the dates of validity, etc.) and will be able to follow its progress. - The deletion of the account results in the loss of the Benefits being acquired or the Benefits acquired by the Customer under this Loyalty Program. c. Duration of the Loyalty Program - The Loyalty Program is valid for a fixed period of time (October 1st of each year points are forfeited). d. Channels for the use of a Loyalty Program - A Loyalty Program is only open on online ordering https://www.hotel-restaurant-aupetitbonheur.com - The channel of use of the Au Petit Bonheur Loyalty Program is specified in the Special Terms and Conditions of the Loyalty Program. - The Online Order corresponds to the orders placed on the website https://www.hotel-restaurant-aupetitbonheur.com - At the time of each order, the Customer must enter his username to log in to his account, in order to benefit from the Loyalty Program, according to the Special Conditions of the Loyalty Program. e. Benefits - The Benefits that the Customer will be able to enjoy are detailed in the Specific Terms and Conditions of the Program, as well as the conditions for obtaining and using these Benefits. - If the Customer has obtained one or more Benefits within the framework of a Loyalty Program, he/she may use them according to the Loyalty Program's usage channel available on the online order: f. Special operations - Points may be awarded to the Client during special and/or temporary offers offered by Au Petit Bonheur to which the Client has subscribed. - The terms and conditions of these operations are specified in the Special Terms and Conditions of the Program. ⇨ (Example: points are added for compensation, in the event of an error by the restaurant on the order placed online). - These additional points will be credited to the Customer Account.2.2 OPERATING RULES SPECIFIC TO THE LOYALTY PROGRAM- A Loyalty Program with a purchase level allows the Customer to accumulate points as and when they make purchases in person (excluding promotions and small events)a. Loyalty points are earned in increments of €1 of the total value of the items in their shopping cart when they place their order. For each price level reached for an order, the customer will receive a number of loyalty points defined by the attribution rate. The award rate is 1 point for every €1 paid, as detailed in the Special Terms and Conditions of the Loyalty Program.Example: for a €1 tier and a 1 point attribution rate, the customer will have 1 loyalty point for every €1 in the cart. For an order with a total value of €32, the customer will have earned 32 points. However, for any order below the €1 threshold, no points will be awarded. The use of Points: - At each milestone reached, the Customer has the possibility either: o To use his points in order to benefit from the Advantage o To keep them to continue to accumulate his points Redemption rate1 point = 0.05€20 Points = 1.00€- Points can be used: o Delivery: with a minimum order of ten (10) euros o To take away: With the purchase of a normal pizza C. The validity date of the Points: - The validity date of the points is identical to the validity date of the Loyalty Program indicated in the Specific Conditions of the Program. - The Customer will not be entitled to any exchange of lost points for cash. - When the Customer has used all their points, their points counter automatically starts from zero. The customer's meter will be credited again as and when purchases are made in the Customer Account in the Loyalty Program.2.3 SPECIAL CONDITIONSThe Loyalty Program is governed by Special Terms and Conditions, which supplement these General Terms and Conditions. In the event of any contradiction between these General Terms and Conditions of Use and the Specific Terms and Conditions of a Loyalty Program, the Special Terms and Conditions shall prevail. CUSTOMER ACCOUNT & ORDERSFor participate in a Loyalty Program, the Customer must be the holder of a Customer Account created on the https://www.hotel-restaurant-aupetitbonheur.com website (including the mobile version) When creating a Customer Account, the Customer chooses a login ID (a valid email address) and a password. When creating a Customer Account, the Customer will be assigned a Customer ID that he must enter with each of his orders on the website to benefit from the Loyalty Program to which he has joined, according to the Specific Conditions of the Loyalty Program. It is the Customer's responsibility to keep their information strictly confidential and not to communicate it to third parties, in order to avoid as much as possible any risk of intrusion of their Customer account and the use of the Loyalty Program(s) to which they have joined without their knowledge by unauthorized persons. Au Petit Bonheur cannot be held responsible for any use of the Client's Account by a third party who has had access to the Client's login ID, password or Client ID in any way whatsoever. When registering, certain mandatory data will be requested from the Client, including their surname, first name, mobile phone number and email address. In the event that the Client loses or forgets his/her password, the Client will have the option of clicking on a link provided for this purpose. The Client will then receive an email to the email address previously provided allowing him to reset his password. Online Orders placed by the Customer as part of a Loyalty Program are subject to the General Terms and Conditions of Sale of the online ordering service accessible via the https://www.hotel-restaurant-aupetitbonheur.com4 website. SUSPENSION / DESACTIVATION4.1. - A Loyalty Program is an operation aimed at providing Benefits to Customers based on the purchases they make personally. This program assumes that the Customer complies with these General Terms and Conditions of Use, the Specific Conditions of the Loyalty Program to which the Customer has subscribed, and that he or she behaves loyally towards Au Petit Bonheur and the Loyalty Program. As a result, Au Petit Bonheur reserves the right to suspend a Customer's participation in the Program, or even to definitively deactivate it and, if necessary, to cancel the associated benefits, in the event of abuse by the Customer in the use of the Loyalty Program. Au Petit Bonheur will carry out this suspension and/or deactivation after notifying the Client, by any means, without the latter being able to claim any compensation, in particular in the following cases: - In the event of fraud, attempted fraud or theft on the part of the Client - In the event of inappropriate use or misuse of the Loyalty Program - In the event of actions likely to disrupt the operation of the website https://www.hotel-restaurant-aupetitbonheur.com the operation of the Program - In the event of an abnormally high number of transactions on the same day of purchases and/or over several days - In the event of non-compliance with the provisions referred to in these General Terms and Conditions of Use. Such termination shall be without prejudice to any possibility of action.4.2. In the event of inactivity of a Loyalty Program to which a Customer has subscribed for a period of 12 consecutive months, the points or accumulation of specific product purchases will be deleted. A Loyalty Program will be considered inactive in which the Customer has not accumulated any points or purchases of a specific product (depending on the nature of the program), nor has he used any of the Benefits he has obtained, during an uninterrupted period of 12 months.5. The Restaurant Au Petit Bonheur cannot be held liable for any damage of any kind, both material nor immaterial, which may result from the improper use of the Loyalty Program by the Customer. Au Petit Bonheur cannot be held liable for the Loyalty Program for any risk inherent in the use of the Internet such as loss of data, intrusion, virus, service disruption or any other similar risk.7. The personal data collected in the context of the Customer's participation in a Loyalty Program is subject to Au Petit Bonheur's personal data protection policy. By joining a Loyalty Program, the Customer agrees to automatically receive by email and SMS the follow-up communications of his Loyalty Program, as well as the good deals and promotions relating to this Loyalty Program. For the purposes of the operation of a Loyalty Program, all information relating to a Customer's purchases within the framework of a Loyalty Program is collected. This information is subject to computer processing in order to process the Customer's requests, to allow him to benefit from the advantages of the Loyalty Program and to send him the good deals and promotions relating to this Loyalty Program that would be offered by Au Petit Bonheur. This information is also used to carry out statistical and marketing studies.8 – ININDIVISIBILITY The nullity of one of the clauses of these General Terms and Conditions of Use pursuant to a law, a regulation or following a court decision will not result in the nullity of these General Terms and Conditions of Use.9. These General Terms and Conditions of Use are subject to French law. In the event of a dispute, the Client will first contact Au Petit Bonheur in order to find an amicable solution. Failing this, jurisdiction shall be assigned to the competent courts of Les Sables d'Olonne.
